Common sense isn’t that common these days and the fact that Supreme Court Judges- the highest legal minds in the country, had to deliberate on this is itself ludicrous to me.

There were a couple of delinquents in Scotland who declared themselves to be women to avoid spending their jail term in a high-security prison for maleas.
Not sure if this case is related or not.

The Supreme Court in London is only for England, Wales and Northern Ireland.

I should add that case law in Scotland is considered “persuasive” in England and Wales and may have been considered accordingly if some Judgment of relevance has been made there.

That may be the case for civil litigation and criminal matters but the UK Supreme Court is the Supreme Court for the whole United Kingdom for constitutional and similar matters. It's worth remembering too that this case arrived at the Supreme Court via the Scottish route.

I hope the Supremes (who choose which few of the many, many cases brought to them, to hear) will hear the weightier cases that need to be decided in the light of extrajudicial if not downright nefarious activity taking place under their noses.
